A man charged in connection with an assault which led to the death of a man in Leigh-on-Sea has had his charge upgraded.

Forty-three year-old Philip Mersh was assaulted in Broadway on October 31.

He died in hospital two days later.

Daniel Ballard, 31, of Lincoln Close, Southend, was arrested following the incident and initially charged with GBH with intent.

Following Mr Mersh’s death, the investigation became a homicide inquiry.

Appearing at Basildon Crown Court today (Friday December 3), Ballard’s indictment was amended to one count of murder and one count of manslaughter.

He pleaded not guilty to both counts and is due to stand trial on July 20 next year.
